What is a DUI/DWI in Georgia?

Georgia law prohibits driving or controlling a vehicle under a variety of conditions, including:

  • With a B.A.C. higher than 0.08%

  • For commercial drivers, the legal limit is lower, at 0.04%.

  • For drivers under the age of 21, any B.A.C. higher than 0.02% will result in DUI/DWI charges.

  • With any amount of marijuana in your blood or urine.

  • Under the influence of any drug, controlled substance, or alcohol.

What Are the Penalties for DUI/DWI?

Penalties for drunk driving can be harsh in Georgia. First-time offenders can serve up to a year in jail if convicted. Additional penalties can include mandatory drug and alcohol treatment, fines as high as $5,000, and up to a year of probation.

Driving while intoxicated while transporting a minor also carries additional penalties, and can lead to a second charge of child endangerment. If convicted, the child endangerment charge can add 12 additional months and $1,000 in additional fines to your DUI/DWI penalties.

Refusing to submit to a sobriety test can also lead to a removal of your driving rights, for a period ranging from 12 months to five years depending on prior convictions.

What Is a Felony DUI?

A felony DUI only occurs when specific factors are involved in a DUI/DWI arrest. An individual may face felony charges if they:

  • have been charged with more than three DUIs within the last ten years

  • fled from an officer while under the influence

  • caused serious harm or death while driving intoxicated

Felony DUI/DWIs carry heavier sentences than misdemeanors. Sentences if convicted range from not less than one year to five years incarceration.
